1. Acceptance Of Terms

These Terms of Service govern access to and use of Bavardio GTM Email and related Bavardio GTM workflow services. By accessing or using the service, you agree to these Terms on behalf of yourself or the organization you represent.

2. Service Description

Bavardio GTM helps authorized users manage lead capture, campaign planning, content review, email sending, operational reporting, audit history, and related go-to-market workflows. The Gmail connection lets an authorized administrator connect a Google account so approved GTM email can be sent through Gmail when enabled.

3. Authorized Use

  • Use the service only for lawful business, marketing, sales, customer operations, and internal workflow purposes.
  • Use only accounts, leads, email lists, and campaign assets that you are authorized to access.
  • Review and approve outbound content before publishing, sending, or posting it.
  • Comply with applicable email, privacy, anti-spam, advertising, and data protection laws.
  • Keep account credentials, OAuth credentials, API keys, and administrator access secure.

4. Prohibited Use

  • Do not send unlawful, deceptive, harassing, infringing, or abusive communications.
  • Do not use the service for spam, purchased-list abuse, credential phishing, malware distribution, or unauthorized scraping.
  • Do not attempt to bypass login controls, lockouts, role permissions, audit trails, or Google OAuth consent requirements.
  • Do not upload or process personal data, confidential information, or regulated data unless you have the right and business need to do so.
  • Do not misrepresent Bavardio, Google, or any third-party integration.

5. User Accounts And Roles

Access may be controlled by WordPress accounts, GTM roles, GTM app password setup links, onboarding status, saved views, and administrator-managed permissions. You are responsible for activity under your account and must promptly report suspected unauthorized access.

6. Gmail Connection

Bavardio GTM Email uses Google OAuth to request permission to send approved GTM email from a connected Gmail account and to identify the connected account email address. Connecting Gmail is optional and should be completed only by an authorized user.

  • gmail.send is used to send reviewed GTM email messages through the connected Gmail account.
  • userinfo.email is used to show and store the connected Google account email address.

You are responsible for making sure the connected Gmail account, sender identity, recipients, message content, and campaign process are authorized and compliant.

7. Content And Campaign Responsibility

You retain responsibility for campaign content, lead data, claims, approvals, distribution decisions, and outcomes. Bavardio may provide workflow tools, templates, tracking, and review gates, but users must ensure accuracy, permission, compliance, and brand readiness before publication or sending.

8. Lead And Recipient Data

You represent that you have appropriate rights, permissions, and lawful basis to collect, enter, import, store, process, contact, or email any lead, prospect, customer, or recipient information used in the service. You must honor unsubscribe, deletion, correction, and suppression requests where applicable.

9. Email Tracking

The service may add click tracking links and an open-tracking pixel to GTM emails. Open tracking can be affected by mailbox privacy features and should be treated as an operational signal, not a guaranteed record that a person read a message.

10. Third-Party Services

The service may interoperate with Google APIs, Gmail, WordPress, Fluent Forms, FluentCRM, Bavardio Platform APIs, and other configured tools. Third-party services are governed by their own terms, privacy policies, availability, limits, and account requirements.

11. Security

  • Do not share passwords, OAuth client secrets, refresh tokens, or API keys with unauthorized people.
  • Use the least privilege needed for each GTM role.
  • Remove or change access promptly when a user no longer needs it.
  • Report suspected misuse, unauthorized access, or suspicious email activity to an administrator.

12. Availability And Changes

Bavardio may update, modify, suspend, or discontinue features as the GTM workflow, security needs, Google API requirements, or business needs change. Some features may depend on third-party availability or administrator configuration.

13. Disclaimer

The service is provided on an as-is and as-available basis to the maximum extent permitted by law. Bavardio does not guarantee campaign performance, lead conversion, email deliverability, third-party service uptime, or legal compliance of user-created content.

14. Limitation Of Liability

To the maximum extent permitted by law, Bavardio will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or loss of goodwill arising from use of the service.

15. Termination

Bavardio or an authorized administrator may suspend or terminate access if a user violates these Terms, creates security risk, loses authorization, or no longer requires access. Users may stop using the service at any time, and administrators may disconnect Gmail access.
